Terms of Service.

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Coach Araza website and the coaching services provided by Innate Fitness LLC ("Coach Araza," "we," "us," or "our"). By using our website, contacting us, or working with us as a client, you agree to these Terms. If you don't agree, please don't use our services.

2. About our services

Coach Araza provides personal training and coaching services, including in-person sessions in Wilmington, Delaware and remote coaching delivered via video and a training app. Specific services include Personal Training, Small Group Training, Lifestyle Coaching, Remote Coaching, the 12-Week Coaching Program, and Youth Training for athletes ages 11 to 18.

Our services are intended to support general fitness, strength, mobility, and movement quality. We are not medical providers, and our services are not a substitute for medical diagnosis, treatment, or therapy.

3. Health disclaimer and your responsibilities

Before beginning any training program with us, you are responsible for:

  • Consulting your physician or healthcare provider, especially if you have any medical condition, injury, recent surgery, or are pregnant
  • Disclosing relevant medical history, injuries, medications, and physical limitations during onboarding and throughout our work together
  • Promptly informing us of any changes in your health status, new injuries, or new diagnoses while we're working together
  • Following instructions during sessions and not attempting exercises or loads beyond what we've agreed are appropriate for you

If you experience pain, dizziness, shortness of breath, or any concerning symptom during or after a session, stop immediately and consult your healthcare provider.

4. Assumption of risk

Physical training carries inherent risks, including but not limited to muscle strain, joint injury, falls, soreness, and aggravation of existing conditions. By participating in our coaching services, you acknowledge these risks and accept them voluntarily. We take reasonable care to minimize risk through proper assessment, progression, and supervision, but no training program can eliminate risk entirely.

5. Booking and scheduling

Introductory calls are scheduled through Cal.com. Ongoing sessions are scheduled by mutual agreement once you become a client. We do our best to maintain consistent appointment times for ongoing clients.

6. Fees and payment

Specific session rates, packages, and payment terms are confirmed in writing when you become a client. Fees are due on the schedule we agree to at onboarding. Failure to pay agreed fees may result in suspension of services until balances are resolved.

7. Cancellation and rescheduling

Sessions cancelled with at least 24 hours notice can be rescheduled at no charge. Cancellations inside 24 hours are generally charged at the full session rate. We handle genuine emergencies — illness, family emergencies — case by case and in good faith.

If we need to cancel a session on our end, we'll reschedule or credit the session at no cost to you.

8. Refund policy

Unused sessions in a prepaid package are generally refundable, less a small administrative charge, when you provide reasonable notice of discontinuing services. Refund terms for specific programs (such as the 12-Week Program) are confirmed in writing when you begin. We don't refund completed sessions.

9. Code of conduct

We expect respectful, honest, professional conduct from clients. We commit to the same in return. We reserve the right to discontinue services with any client whose conduct is unsafe, dishonest, harassing, or otherwise inconsistent with a professional coaching relationship.

10. Youth training

Coaching services for athletes ages 11 to 18 require a parent or legal guardian to authorize the engagement, attend the initial intake, and remain involved through regular check-ins. Parents are responsible for transportation, medical disclosures, and any guardian-related consents.

11. Use of the website

You may use our website for personal, lawful purposes. You may not attempt to disrupt the website, gain unauthorized access to any systems, copy or republish our content without permission, or use automated tools to scrape or harvest information.

12. Intellectual property

The content on this website — including text, images, design, logo, and the training programs and materials we create for clients — is owned by Innate Fitness LLC or licensed to us, and is protected by copyright and other intellectual property laws. Personal training programs delivered to clients are for the client's personal use; please don't redistribute or resell them.

13. Photography and likeness

From time to time we may take photos or video during sessions for our own records, social media, or marketing. We will ask for your written permission before using any image or video that identifies you. You can withdraw consent at any time.

14. Limitation of liability

To the maximum extent permitted by law, Innate Fitness LLC and Coach Araza are not liable for indirect, incidental, or consequential damages arising from your use of our website or services. Our total liability for any claim arising from our services is limited to the amount you paid us for the specific service giving rise to the claim.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct.

15. Indemnification

You agree to indemnify and hold harmless Innate Fitness LLC, Coach Araza, and Andrew Araza from any claims, losses, or expenses arising from your breach of these Terms or your participation in coaching services in ways inconsistent with our instructions.

16. Termination

Either party can end the coaching relationship at any time, for any reason or no reason, with reasonable notice. Outstanding balances remain due, and unused prepaid sessions are addressed under the refund policy above.

17. Changes to these terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. For material changes, we'll post notice on the website. Your continued use of the website or services after changes take effect constitutes acceptance of the updated Terms.

18. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising from these Terms or our services will be resolved in the courts of Delaware, unless we mutually agree to alternative dispute resolution.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
